1. What this policy covers
This policy applies to every paid Ampere subscription bought from Cyntech Engineers & Managers (RF) (Pty) Ltd. (registration 2015/439843/07), trading as Ampere, through https://ampere.cyntech.io. It sits alongside the Terms and Conditions and does not limit any right you have under South African law.
The Free plan costs nothing, so nothing is ever refundable on it. You may delete a free account at any time from your account settings.
All prices are quoted in South African Rand and include VAT where VAT applies.
2. Your seven-day cooling-off right
Because you buy your subscription electronically and never meet us face to face, section 44 of the Electronic Communications and Transactions Act gives you the right to cancel within seven (7) calendar days of the payment, without giving a reason and without penalty.
Where you exercise that right we refund the full amount paid within thirty (30) days of the cancellation. The only amount we may keep is the direct cost of returning anything to us, and since Ampere is a purely digital service there is no such cost.
To use this right, email ashley@cyntech.io from the address on your account, or cancel from the Billing page and tell us you are relying on your cooling-off right.
3. Cancelling after the cooling-off period
You may cancel a monthly or annual subscription at any time from the Billing page in your account, or by emailing ashley@cyntech.io. No notice period and no cancellation fee apply.
Cancellation stops the next renewal. Your paid features stay available until the end of the period you have already paid for, after which the account falls back to the Free plan. We do not pro-rate or refund the unused part of a period you chose to run out, except where paragraph 4 or 5 applies.
Your logged trips, sessions and evidence are not deleted when you downgrade. Features that are not on the Free plan simply become read-only until you upgrade again or export your data.
4. When we will refund you
We refund in full, on request, where: you cancel within the seven-day cooling-off window; you were charged after cancelling; you were charged twice for the same period; or a paid feature you subscribed for was unavailable or materially broken for more than seventy-two (72) continuous hours in a billing period and you told us about it at the time.
We refund pro rata where we materially reduce or withdraw a paid feature during a period you have paid for, or where we increase your price without giving you at least thirty (30) days' notice and a chance to cancel.
Section 54 of the Consumer Protection Act entitles you to a service of a quality that a reasonable person would expect. If we fall short of that, you may ask us to put it right or to refund a reasonable portion of what you paid.
5. When we will not refund you
We do not refund simply because a subscription went unused, because you forgot to cancel before a renewal you had notice of, or because a route plan did not match your own expectation of range.
Ampere reports measured charger performance and driver-reported reliability. It is decision support, not a guarantee. A charger being offline, occupied, slower than its advertised rating, or priced differently by its operator is not a defect in Ampere and is not a refundable event.
We do not refund charges caused by someone using your account after you shared your password or failed to secure it, as set out in the Terms.
6. Annual subscriptions
An annual subscription is charged upfront at ten months' price for twelve months' access. Outside the cooling-off window, cancelling an annual subscription stops the next renewal and access continues to the end of the paid year.
Where we owe you a pro-rata refund on an annual subscription under paragraph 4, we calculate it on the amount actually paid divided by the number of days in the term, multiplied by the days remaining.
7. Free trials, promotions and vouchers
Where a free trial is offered, no charge is made until the trial ends. We tell you the date the first charge falls due, and you may cancel before it without paying anything.
Promotional discounts and vouchers have no cash value and are not refundable for cash. A refund of a discounted subscription is limited to the discounted amount you actually paid.
8. How to claim, and how long it takes
Email ashley@cyntech.io with the email address on your account, the payment date and what happened. You may also use the contact form on the site.
We acknowledge every refund request within two (2) business days and decide it within seven (7) business days. Approved refunds go back to the original payment method within ten (10) business days of approval, though your bank or card issuer may take longer to show it.
We refund to the original payment method only. We do not pay refunds in cash or to a third party's account.
9. Chargebacks and disputes
Please raise a dispute with us before instructing your bank. A chargeback lodged without contacting us first may result in the account being suspended until the dispute is resolved.
If you are unhappy with our decision, you may escalate it to the National Consumer Commission or to the Consumer Goods and Services Ombud. Nothing in this policy takes away your right to do so.
10. Changes to this policy
We may update this policy. The version and effective date at the top of this page always show which one applies, and the terms in force on the day you paid are the terms that govern that payment.
